What are the requirements for auto insurance in Utah?

The state of Utah requires all drivers to carry both liability insurance as well as personal injury protection (PIP) to provide no-fault insurance coverage.

The minimum liability requirement is $25,000 per person and $65,000 per incident for bodily injury in an accident, and $15,000 in property damage liability. That puts Utah in line with most other states in terms of how much liability coverage is required, although the property damage limit is on the low side.

Utah drivers can also select a combined single limit policy. The minimum limit for this type of policy is $80,000, and this amount covers both bodily injury and property damage.

In addition to providing financial responsibility for an accident where you are at fault, Utah also mandates that all drivers carry at least $3,000 in PIP coverage. This no-fault coverage pays medical bills for yourself and passengers in your care in an accident, regardless of which driver is responsible for the accident.

Although not required by the state, comprehensive coverage and collision coverage are usually required on vehicles that are leased or financed. Check with your lender or lease provider to find out what kind of coverage is mandated by your agreement.

Are there any specifics to purchasing auto insurance in Utah?

Utah uses a form of no-fault insurance, which means that regardless of who is at fault or even if the fault has been determined, you can file a claim with your own insurance company for injuries and receive payment up to the limits of your PIP coverage. At the legal minimum, that would be $3,000 – but Utah drivers can (and should) choose to carry a higher limit on this coverage in order to be better protected.

In spite of the use of no-fault PIP coverage, the fault will still be determined in the accident, and the driver who is found at fault will be held responsible for property damage and for any injury-related costs that exceed the other driver’s PIP coverage.

Utah uses comparative negligence to determine fault, which means the fault may be 0%-100%, 50%-50%, or anywhere in between. If a driver is found to be less than 50% at fault in the accident, they can seek damages from the driver found to be more than 50% at fault. However, the insurance company may only pay out the percentage of damages that matches the percentage of fault. For example, if the other driver is found to be 75% at fault, their insurance company need only pay 75% of the damages. This makes carrying higher PIP coverage limits even more important.
